Overview

The United Kingdom (UK) formally left the European Union (EU) on 31 January 2020 and entered into a transition period as part of the Withdrawal Agreement between the UK and the EU. The transition period ended on 31 December 2020.

We have set out below answers to the most common questions raised by customers. 

Is Chubb Brexit Ready?

Yes. Chubb’s primary underwriting operation in the UK and Europe is Chubb European Group SE (“CEG SE”). On 1 January 2019 CEG SE successfully redomiciled from the UK to France and now operates under the supervision of the French Prudential Supervision and Resolution Authority (“ACPR”) CEG SE continues to operate in the UK through a branch and to take advantage of the UK’s Temporary Permissions Regime. CEG SE has branch offices across Europe and holds cross border permissions throughout the EEA.

Why France?

Our preferred location of France was clear and straightforward. Chubb has a long-established, vital presence in the French market, with several hundred employees serving businesses of all sizes, as well as a vibrant consumer market in which we offer a wide range of products. Paris is also the principal office for our Continental European operation, allowing us to capitalise on the management and staff already present in the city as we build our EU headquarters. Choosing France reflected our existing strong commitment both to the French market and the larger European market. In considering France as the future home of our legal entity, we worked closely with the ACPR.

What will happen to Chubb’s London headquarters?

CEG SE continues to have a substantial presence in London which remains its Regional EMEA headquarters.

What are CEG SE’s registration and authorisation details?

CEG SE is headquartered in France with its registered office at La Tour Carpe Diem, 31 Place des Corolles, Esplanade Nord, 92400 Courbevoie. It is entered into the Nanterre companies register under number 450 327 374. Since 1 January 2019, CEG SE has been authorised and supervised by the ACPR.  

CEG SE UK operations remain based at Chubb’s Regional EMEA headquarters at 100 Leadenhall Street, London EC3A 3BP, with additional offices throughout the UK.  As a branch of an EEA company, CEG SE operates in the UK through the Temporary Permissions Regime while it seeks full authorisation. 

Following the end of the transition period on 31 December 2020, what is Chubb’s status in the UK?

Chubb continues to have a branch in the UK, which is registered with Companies House and operates in the UK under the Temporary Permission Regime. Further information is set out in our new disclosure which reads as follows:

  • Chubb European Group SE (CEG) is a Societas Europaea, a public company registered in accordance with the corporate law of the European Union.  Members’ liability is limited.  CEG is headquartered in France and governed by the provisions of the French insurance code.  Risks falling within the European Economic Area are underwritten by CEG, which is authorised and regulated by the French Prudential Supervision and Resolution.  Registered company number: 450 327 374 RCS Nanterre.  Registered office: La Tour Carpe Diem, 31 Place des Corolles, Esplanade Nord, 92400 Courbevoie, France. Fully paid share capital of €896,176,662. 
  • CEG’s UK branch is registered in England & Wales. Registered address: 100 Leadenhall Street, London EC3A 3BP. Authorised by the Prudential Regulation Authority and with deemed variation of permission. Subject to regulation by the Financial Conduct Authority and limited regulation by the Prudential Regulation Authority. Details of the Temporary Permissions Regime, which allows EEA-based firms to operate in the UK for a limited period while seeking full authorisation, are available on the Financial Conduct Authority’s website (FS Register number 820988).

Why does Companies House say that Chubb European Group SE is closed?

CEG SE’s UK company registration fell away when it redomiciled to France.  You can now find CEG SE on the Nanterre companies register under number 450 327 374. Following the end of the Transition Period, CEG SE’s UK branch is registered with Companies House under number BR023093. CEG SE’s UK branch is recognised by both the Prudential Regulation Authority (“PRA”) and FCA and can be found on the Financial Services Register under reference number 820988.

How will CEG SE continue to insure UK and European risks?

From  the end of December 2020, CEG SE has benefited from the UK Government’s Temporary Permissions Regime. This allows CEG SE to operate in the UK and continue to write business in the same way as it always has. The Temporary Permissions Regime will be in place for up to three years from the end of the Transition Period (31 December 2020). During that time CEG SE will establish an international branch in the UK. The UK branch will be authorised by the Prudential Regulation Authority while also remaining part of the same legal entity CEG SE. This will enable CEG SE to continue to operate in the UK beyond the expiry of the Temporary Permissions Regime.

Will underwriters based in the UK be able to take underwriting decisions for CEG SE, a French domiciled insurer?

Yes, UK underwriters are able to issue one policy with one stamp covering UK and EEA risks. Our primary aim has been to ensure a seamless transition and to offer certainty and continuity of service for all our customers and our business partners, regardless of location. What will happen to policies issued prior to Brexit and payment of claims?

There has been no change. The Temporary Permissions Regime allows CEG SE to continue to service existing policies and pay claims.

How is Lloyd’s market business impacted by Brexit?

Our Lloyd’s managing agency, Chubb Underwriting Agencies Ltd (CUAL), continues to be able to underwrite business in the EEA and elsewhere, through its arrangement with Lloyd’s Insurance Company SA (Lloyd’s Brussels) and its Lloyd’s Syndicate 2488, respectively.

Lloyd’s will transfer certain EEA insurance policies to Lloyd’s Brussels via a Part VII transfer, expected to be effective on 31 December 2020. The proposed transfer will not change terms and conditions of any policy, except that Lloyd’s Brussels will become the insurer and Data Controller in respect of the transferred policies. Is Chubb’s Life Company impacted by Brexit?

On 1 January 2019, Chubb Life Europe SE (“CLE SE”) also successfully redomiciled from the UK to France.   CLE SE is now headquartered in France with its registered office at La Tour Carpe Diem, 31 Place des Corolles, Esplanade Nord, 92400 Courbevoie.  It is entered into the Nanterre companies register under number 497 825 539. Since 1 January 2019, CLE SE has been authorised and supervised by the ACPR.  

The UK branch of the company is based at Chubb’s Regional EMEA headquarters at 100 Leadenhall Street, London EC3A 3BP.  As a branch of an EEA company,  CLE SE operates in the UK under the Temporary Permissions Regime while it seeks full authorisation. CLE SE changed with effect from 31 March 2021. Previously the company was known as ACE Europe Life SE.

Will the Brexit changes affect Chubb’s credit rating?

We continue to benefit from the S&P “AA” rating assigned to core operating companies within the Chubb Group.

Will it affect the policy I have with you?

There will be no change to the cover afforded to our policyholders under their existing policies or any changes in their rights, premiums or benefits under the policy. Our customers will benefit from continuing to receive insurance cover from the same legal entity with the same level of capital. There will be no change to the level of customer service or your point of contact.

Will Brexit affect the governing law and jurisdiction of my insurance contract?

The choice of law to govern an insurance contract will not be impacted by Brexit. 

Will my premium(s) change?

Our Brexit changes will have no effect on the amount of your premium(s).

Will there be any costs to me associated with this change?

You will not incur any costs as a result of our Brexit changes.

Will this change my terms and conditions?

No. Our Brexit changes will have no effect on your terms and conditions.

Will it change how I contact you?

There is no change to the current contact name or contact numbers you use currently. Please continue to contact us in the usual way. There may be changes to some numbers in due course, but we will advise you if this is the case in good time.

Will I still have access to the UK's Financial Ombudsman Service ("FOS")?

If you are an eligible UK customer and  you were previously able to bring complaints to the FOS, you will continue to be able to do so after the end of the transition period.  

Will I still have access to the UK's Financial Services Compensation Scheme ("FSCS")?

If you are an eligible UK customer and were previously protected by the FSCS you will continue to benefit from this protection after the transition period ends.

EEA Customers

Is Chubb still able to process the personal information of EU citizens after Brexit?

Yes. From time to time we may need to share your personal data with members of the Chubb group who may be based in the EU or outside Europe (outside of the European Economic Area). We may also allow our service providers or assistance providers, who may be located outside Europe, access to your personal data. We may also make other disclosures of your personal data overseas, for example if we receive a legal or regulatory request from a foreign law enforcement body.

We will always take steps to ensure that any international transfer of information is carefully managed to protect your rights and interests:

  • We will only transfer your personal data to countries which are recognised as providing an adequate level of legal protection or where we can be satisfied that alternative arrangements are in place to protect your privacy rights;
  • Transfers within the Chubb group of companies will be covered by an intra-group agreement which gives specific contractual protections designed to ensure that your personal data receives an adequate and consistent level of protection wherever it is transferred within the Chubb group;
  • Transfers to service providers and other third parties will always be protected by contractual commitments and where appropriate, further assurances;
  • Any requests for information we receive from law enforcement or regulators will be carefully checked before personal data is disclosed.
